Website Terms of Use and Donation Policy

1. General
1.1. The website (http://www.erad.co.il) (the **“Website”**) is operated by ERAD – Friends of Schneider Emergency Medicine Association, Registered Association No. 580303840, whose address is 14 Eliezer Kaplan Street, Petah Tikva 4920235, Israel (the **“Association”**).
1.2. The Website provides information about the Association, its activities, and the Emergency Medicine Department at Schneider Children’s Medical Center of Israel, and enables users, among other things, to make donations to the Association.
1.3. These Terms govern the use of the Website and the making of donations through it. By using the Website or making a donation through it, the user confirms that they have read, understood, and agreed to these Terms.
1.4. These Terms apply equally to all users, regardless of gender. Any use of a particular gender is for convenience only.
1.5. The section headings are provided for convenience only and shall not be used for the interpretation of these Terms.
2. Eligibility to Use the Website and Make Donations
2.1. The Website may be used by any person, subject to these Terms and all applicable laws.
2.2. A donation or payment through the Website may only be made by a person who is at least 18 years of age, has the legal capacity to perform the transaction, and is legally authorized to use the selected payment method.
2.3. By making a donation, the donor declares that the information provided is accurate, complete, and correct and that the payment method used belongs to the donor or that the donor is legally authorized to use it.
2.4. The Association may refuse, suspend, or cancel a donation if it suspects unauthorized use of a payment method, the provision of incorrect information, fraud, money laundering, or any other activity that violates applicable law.
3. Donations Through the Website
3.1. The Website enables donors to make either a one-time donation or a recurring monthly donation, subject to the options available through the donation system at the time of the donation.
3.2. The donor may select the donation amount, subject to the options and limitations displayed on the Website or through the payment system.
3.3. A donation may be made in support of the Association’s general activities or designated for a particular project selected from the projects presented on the Website, where such an option is available.
3.4. The Association will make reasonable efforts to use a donation designated for a particular project for the purpose selected by the donor. If the project has been completed, cancelled, modified, fully funded, or if it is no longer possible to use the donation for the selected purpose, the Association may use the donation for a similar purpose or for another purpose consistent with the Association’s objectives, according to current needs and at the Association’s discretion.
3.5. All donations are voluntary and do not entitle the donor to receive any product, service, consideration, benefit, membership in the Association, or influence over the Association’s decisions.
3.6. Photographs, descriptions, goals, and amounts relating to particular projects are provided for informational and illustrative purposes. Projects, the needs of the Emergency Medicine Department, costs, schedules, and the allocation of donations may change from time to time.
4. Payment Methods and Processing
4.1. Donations are processed through GROW and the payment service providers operating in cooperation with it.
4.2. Subject to the options available through the payment system at the time of the donation, payments may be made by credit card, bit, PayBox, digital wallets, bank transfer, and any other payment methods that may be made available from time to time.
4.3. Completion of a donation is subject to authorization by the payment processor, the relevant payment service provider, credit card company, or bank. The Association shall not be responsible for a rejected payment or any malfunction originating with these service providers.
4.4. Donations may be made in New Israeli Shekels or in foreign currencies, subject to the options available through the payment system. Donations made in a foreign currency may be subject to exchange rates, conversion fees, or other charges imposed by the payment service provider, credit card company, or the donor’s bank. The Association does not determine and shall not be responsible for such charges.
4.5. Payment information is entered into the payment system and processed by the relevant payment service providers. The Association does not retain full credit card details on the Website.
5. Recurring Monthly Donations
5.1. By selecting a recurring monthly donation, the donor authorizes recurring charges to the selected payment method in the amount and at the frequency selected, until the authorization is cancelled.
5.2. The donor may request the cancellation of a recurring monthly donation at any time by contacting the Association by email at [info@erad.co.il](mailto:info@erad.co.il) or by telephone at +972-3-9253658.
5.3. The Association will take reasonable steps to stop future charges within a reasonable period following receipt of the request, subject to the processing times of GROW and the relevant payment service provider. Donors are advised to submit cancellation requests several business days before the next scheduled charge.
5.4. A request to discontinue a recurring monthly donation will apply to future charges only and will not automatically cancel charges that have already been processed. Any request for a refund of a charge already processed will be considered in accordance with the cancellation and refund policy set out below.
5.5. If a recurring charge cannot be processed due to a payment refusal, expiration of the payment method, or any other reason, the Association or the payment service provider may attempt to process the charge again or contact the donor to update the payment method.
6. Receipts and Tax Recognition
6.1. Once a donation has been completed and approved, a receipt will be sent to the donor by email through the GROW system, based on the information provided by the donor.
6.2. The donor is responsible for providing a valid and accurate email address and for reviewing the receipt upon receiving it. If the receipt contains incorrect information, the donor may contact the Association to request that the matter be reviewed and corrected, where possible and in accordance with applicable law.
6.3. As of the date on which these Terms were last updated, the Association’s application for approval under Section 46 of the Israeli Income Tax Ordinance is still being processed, and the Association does not yet hold a valid approval under that section.
6.4. Accordingly, a receipt issued for a donation does not, in itself, constitute confirmation that the donation qualifies for an Israeli tax credit under Section 46. If and when the Association receives such approval, eligibility for any tax benefit, its scope, and its effective date will be determined in accordance with the approval and applicable law.
7. Anonymous Donations
7.1. A donor may request that their name not be published and that their donation be presented publicly as an anonymous donation.
7.2. An anonymous donation means that the Association will not publicly disclose the donor’s identity unless it is legally required to do so.
7.3. For payment processing, receipt issuance, accounting, fraud prevention, and compliance with legal requirements, the donor may still be required to provide identifying information to the Association, GROW, or other payment service providers. Therefore, a donation that is anonymous to the public may not necessarily be anonymous to the Association or its payment service providers.
8. Donation Cancellation, Amount Changes, and Refunds
8.1. A donor who has made a donation by mistake, entered an incorrect amount, or wishes to change or cancel a donation should contact the Association as soon as possible by email at [info@erad.co.il](mailto:info@erad.co.il) or by telephone at +972-3-9253658.
8.2. The request should include the donor’s name, the date and amount of the donation, the payment method used, and any additional information reasonably required to identify the donation and verify the requester’s identity. The donor must not send a full credit card number or card security code to the Association by email.
8.3. Each cancellation, modification, or refund request will be considered in good faith, taking into account the particular circumstances, applicable law, the date of the request, the technical ability to cancel the payment, the policies of GROW and the relevant payment service provider, and whether the donated funds have already been allocated or used for their intended purpose.
8.4. Where it is clear that the donation was made as a result of an error in the amount or that the charge does not reflect the donor’s intention, the Association will take reasonable steps, where possible and in accordance with applicable law, to correct or cancel the charge.
8.5. Where a refund is approved, it will be made, where possible, through the same payment method used for the donation. The time required for the refund to appear in the donor’s account depends on the relevant payment service provider, credit card company, or bank.
8.6. If the cancellation or refund involves a cancellation fee, currency conversion fee, bank transfer fee, or payment processing fee that is not refunded to the Association, the Association may deduct the reasonable direct cost from the refunded amount, subject to applicable law.
8.7. Nothing in these Terms shall limit any right granted to a donor under applicable law or under the terms of the relevant payment service provider.
9. Donations From Outside Israel
9.1. The Website enables donations from donors in Israel and other countries, subject to the available payment options, the limitations of the payment system, and applicable law.
9.2. A donor residing outside Israel is responsible for examining any tax, reporting, or legal implications that may apply in the donor’s country of residence.
9.3. The Association does not represent or guarantee that a donation will be recognized for tax purposes outside Israel or that a receipt issued in Israel will entitle the donor to any tax benefit in another country.
9.4. The Association may refuse to accept a donation from a particular country, person, organization, or payment method if accepting it is prohibited by law, restricted by a payment service provider, or raises a legal or operational concern.
10. Personal Information and Privacy
10.1. To make a donation, the donor may be required to provide information such as their name, address, email address, and telephone number.
10.2. Personal information submitted through the Website will be handled in accordance with the Website’s Privacy Policy, which forms an integral part of these Terms.
10.3. Users should review the Privacy Policy before submitting personal information or making a donation.
10.4. Making a donation does not automatically add the donor to the Association’s mailing list.
10.5. Subscription to the mailing list takes place only by completing the designated subscription form on the Website and providing the appropriate consent. Subscribers may request removal from the mailing list at any time by using the unsubscribe option included in the relevant communication or by contacting the Association.
11. Permitted Use of the Website
11.1. The Website and its content may not be used for any unlawful, harmful, misleading, or unauthorized commercial purpose.
11.2. Users must not perform any action that could interfere with or damage the Website, its security, its systems, its users, or any third party.
11.3. Users must not introduce malicious code, attempt to gain unauthorized access to the Website or its systems, collect information by automated means, or bypass security or authorization mechanisms.
11.4. The Association may restrict or block access to the Website if it is used in violation of these Terms or applicable law.
12. Intellectual Property
12.1. All copyrights and intellectual property rights in the Website and its content, including text, design, photographs, videos, marks, names, logos, and files, belong to the Association or to third parties that have authorized the Association to use them.
12.2. No content from the Website may be copied, reproduced, distributed, published, sold, modified, publicly displayed, or used for commercial purposes without the prior written permission of the applicable rights holder.
12.3. Users may share a link to a publicly accessible page of the Website, provided that the link is shared lawfully, fairly, and without creating a misleading impression regarding any relationship between the person sharing it and the Association.
13. Medical Information
13.1. Information appearing on the Website regarding the Emergency Medicine Department, medical equipment, medical activities, or health-related matters is provided for general informational and educational purposes only.
13.2. Nothing on the Website should be considered medical advice, a diagnosis, a treatment recommendation, or a substitute for consultation with a qualified medical professional.
13.3. In the event of a medical emergency, the appropriate medical or emergency services should be contacted without delay.
14. Third-Party Links and Services
14.1. The Website may include links, systems, or services operated by third parties, including GROW, payment service providers, social media platforms, and external websites.
14.2. Use of such services may also be subject to the terms and privacy policies of the relevant third parties.
14.3. The Association does not control third-party services and shall not be responsible for their availability, security, content, policies, or actions.
15. Liability and Website Availability
15.1. The Association makes reasonable efforts to ensure that the information on the Website is accurate and current. However, the Website may contain errors, inaccuracies, or information that has not yet been updated.
15.2. The Website and the services offered through it are provided on an “as is” and “as available” basis. The Association does not guarantee that the Website will operate without interruptions, malfunctions, delays, or security incidents.
15.3. The Association may modify, update, suspend, or discontinue any part of the Website or the services offered through it, temporarily or permanently.
15.4. Subject to applicable law, the Association shall not be liable for indirect or consequential damage resulting from the use of the Website, reliance on its content, a malfunction involving a third-party service, or unauthorized use of the Website.
15.5. Nothing in this section excludes or limits any liability that cannot lawfully be excluded or limited.
16. Amendments to These Terms
16.1. The Association may amend these Terms from time to time, including as a result of changes to the Website, payment methods, the Association’s activities, or applicable law.
16.2. The updated version will be published on the Website and will state the date on which it was last updated.
16.3. Continued use of the Website after publication of the updated Terms will constitute acceptance of the updated version.
17. Governing Law and Jurisdiction
17.1. The use of the Website, all donations, and these Terms shall be governed by the laws of the State of Israel.
17.2. Any matter relating to the Website or these Terms shall be subject to the jurisdiction of the competent courts in Israel, in accordance with applicable law.
17.3. Before initiating legal proceedings, users are encouraged to contact the Association and provide it with a reasonable opportunity to review the matter and assist in resolving it.
